جلسه نوزدهم:
درمساله گذشته که ذمی مرتدی را بکشد، علاوه برعدم قصاص محقق و آقای خوئی قائل به عدم دیه هم شده اند.

جمله بندی خارج از چارچوب قواعد دستور زبان فارسی است

اشکال صاحب جواهر به مرحوم محقق:
که اگر در جایی که مسلمانی مرتدی را میکشد نه دیه ونه قصاص را ثابت کردید، این ملازم با مهدوریت است که موجب میشود درجایی که ذمی هم اورا میکشد قصاص نشود پس قصاص ذمی تهافت درکلام محقق است.

عبارات ناقص و بهم ریخته است

ولازمه دیگر این حرف این است که جایی هم که مرتدی مرتدی را وحربی حربی ای را بکشد قصاص نشوند، وحال آنکه قصاص میشود. تم کلامه رفع مقامه.
استاد: این اشکال تمام نیست، زیرا نسبت به مسلم مرتد مهدور است ونمیشود ازآن دربحث ذمی استفاده کرد.

نیازمند توضیح بیشتر است

منشا این توهم که مرتد برای هرشخصی خونش مباح است روایتی است دراین باب:
که (دمه مباح لکل من سمع ذلک منه)...الحدیث.

تقریب استدلال به روایت بیان شود و در ادامه اشکال بیاید

اشکال: این روایت مخصوص به قسم خاصی ازمرتد است که جهود نبوت وتکذیب رسول ص باشد که مفاد آن همان مفاد سب النبی میشود. اما اینکه هرمرتدی مهدور است، دلالتی ندارد.
*وجه سومی هم دراینجا احتمال میرود که شاید مبنای فقها نسبت به مهدوریت مرتد باشد:
دربرخی ازروایات معتبرآمده که (بالاسلام حقنة الدماء فاذا قالوها عصموا منی دمائهم...)
مفهوم مقامی آن(مقام حصر وتحدید عصمت) این است که اگر کسی مسلمان نبود محقون نیست. وشکی هم نیست که مرتد مسلمان نیست ومعصوم الدم هم نخواهد بود. پس اگر ذمی هم بکشد قصاص نخواهد شد.
استاد: استناد به این روایات صحیح نیست گرچه فقها شاید استناد بکنند.
زیرا کفاری که درحرب بامسلمانان نیستند موجبی برای کشتن آن ها نیست.
زیرا مفاد این روایات را بسیاری ازفقها بریده ازصدر وذیل نقل کرده اند. بلکه مفاد این روایات مخصوصا آنچه که درلسان اهل تسنن آمده این است که اگر کسی شهادتین است دیگر بهانه ای نیاورید وکسی حق تعرض ندارد نه اینکه اگر نگفتند علی الاطلاق حق تعرض دارید!

افعال نادرست بکار رفته است، مثلا: اگر کسی شهادتین است!!!؟؟ ، جمله بندی ناقص و نامرتب است و..

زیرا درفقه الحدیث این روایات که تامل شود مورد جایی است که مسلمانان میرفتند تجسس در تقیه وعدم تقیه ای بودن اسلام کفار میکردند.
پس این قانون اسلام عام را اجرا میکند

فاعل و مفعول در این جمله مشخص نیست

که نادیده گرفتن آن بسیاری ازفرقه های ضاله را پدید آورده.
سیره پیغمبر ص هم این نبوده که راه بیفتن تا هرکسی که مسلمان نیست حکم به قتل آنها بکنند.
حقیر: اگر این باشد پس در ساب النبی هم این رابگویید که پیغمبر وامیرالمومنین اینها را نمیکشتند به صرف این مورد، پس نباید مهدور باشند.

اشکال را با ذکر مقدمه و صغری و کبری تبیین نمایید. اگر چی باشد؟؟ ساب را نمی کشتند؟ مستندات ارائه دهید یا آدرس بدهید...

پس تقطیعی که فقها کردند موجب اخلال به معنا شده.
