قسم دوم: تناقض متعارضین یا تضاد متعارضین لاثالث لهما
منظور ما از تناقض معنای اوسعی است به این معنا که کذب هر دو محتمل نیست بلکه کذب یکی که به حسب تعارض مفروض است مستلزم صدق دیگری است.
در اینجا مقتضای اصل اولی و مقتضای دلیل عام حجیت تساقط است. زیرا در اینجا چهار احتمال است که سه احتمال اول محتمل نیست و احتمال چهارم که تساقط است متعین است.
اول: حجیت هر دو:
حجیت متعارضین محتمل نیست. اجتماع حجیتین به معنای حجیت تنجیز و تعذیر است.
دوم: حجیت احدهما معینا:
ترجیح بلامرجح است
سوم: حجیت تخییریه:
شهید صدر در اینجا معانی مختلفی که از حجیت تخییریه را تصویر کرده اند
معنای...: حجیت هریک مشروط به کذب دیگری، یعنی هر اماره ای مشروط به کذب دیگری حجت باشد.
شرط حجیت تخییریه چهار امر است تا این امور نباشد حجیت تخییریه محقق نیست.
1. تنافی بین دو دلیل بواسطه حجیت تخییریه که بواسطه تقیید اطلاق دلیل حجیت است متتفی شود.
می فرمایند: هیچکدام از این صور هفتگانه شامل این شروط چهارگانه نیست.
متحصل از کلام ایشان در قسم دوم تساقط است.
در مقام حالت دیگری که تنافی بین دو دلیل به تضاد باشد مانند وجوب جمعه و استحباب جمعه
مقتضای اصل اولی در اینجا حجیت فی الجمله است که نتیجه ی آن نفی ثالث است. چون علم به کذب یکی وجود دارد شرط حجیت احراز می شود و حجیت دیگری مشکلی ندارد. و چون حجیت احدهما اثبات می شود ثمره ای جز نفی ثالث ندارد.
در اینجا حجیت احدهما لغو نخواهد بود. فرد مردد یعنی حجیت بر یکی مردد است ولی اینجا حجیت تخییریه است هر کدام از این دو حجت هستند مشروط به کذب دیگری. اگر می خواستیم حجیت را بر فرد بگذاریم حجیت احدهما مردد ممکن نبود ولی اینجا می خواهیم حجیت را بر هر دو به نحو تخییریه جعل کنیم به شرط اینکه دیگری کذب باشد.
ایشان یک فرض از چهار فرض را تساقط دانستند که فرض رابعه بود.
