محل ارسال تقریرات فقه جلسه ۵ (شنبه ۹۷/۶/۱۰) از طریق «پاسخ به موضوع»

آیا ضربی که منجر به دیه نشود مقصود از امر و نهی هست و یا دلیلی بر وجوب آن داریم یا خیر؟ در مورد ادله از اجماع بحث کردیم و همچنین گفتیم رویات به دو دسته تقسیم می شوند دسته اول نیز بحث شد. طایفه ثاینه خود به چهار دسته تقسیم می شوند
1. روایاتی که خود عنوان ضرب و صک در دلیل اخذ شده است
2. روایاتی که عنوان ید در آن آمده که قدر مسلم آن ضرب است.
3. طائفه سوم روایاتی است که بین ید و لسان ملازمه قائل شده است
4. طایفه چهارم روایاتی است که حکم در آنها روی عناوین مسببه ای رفته است مثل تغییر ، ایذاء و...
اما طائفه اول: عن ابی جعفر علیه السلام: وانکروا بقلوبکم والفظوا بالسنتکم و صکوا بها جباههم... صاحب وسائل این روایت را ذکر کرده اند ولی هیچ جا تمام روایت را نیاورده و هرجا به تناسب عنوان باب بخشی از آن را آورده است و چون تقریب استدلال به این حدیث متوقف براین است که کل حدیث دیده بشود این روایت را از کتاب شریف کافی بررسی می کنیم.
1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ بِشْرِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي عِصْمَةَ قَاضِي مَرْوَ عَنْ جَابِرٍ عَنْ أَبِي جَعْفَرٍ ع قَالَ: يَكُونُ فِي آخِرِ الزَّمَانِ قَوْمٌ يُتَّبَعُ فِيهِمْ قَوْمٌ مُرَاءُونَ يَتَقَرَّءُونَ وَ يَتَنَسَّكُونَ حُدَثَاءُ سُفَهَاءُ لَا يُوجِبُونَ أَمْراً بِمَعْرُوفٍ وَ لَا نَهْياً عَنْ مُنْكَرٍ إِلَّا إِذَا أَمِنُوا الضَّرَرَ يَطْلُبُونَ لِأَنْفُسِهِمُ الرُّخَصَ وَ الْمَعَاذِيرَ يَتَّبِعُونَ زَلَّاتِ الْعُلَمَاءِ وَ فَسَادَ عَمَلِهِمْ يُقْبِلُونَ عَلَى الصَّلَاةِ وَ الصِّيَامِ وَ مَا لَا يَكْلِمُهُمْ فِي نَفْسٍ وَ لَا مَالٍ وَ لَوْ أَضَرَّتِ الصَّلَاةُ بِسَائِرِ مَا يَعْمَلُونَ بِأَمْوَالِهِمْ وَ أَبْدَانِهِمْ لَرَفَضُوهَا كَمَا رَفَضُوا أَسْمَى الْفَرَائِضِ وَ أَشْرَفَهَا إِنَّ الْأَمْرَ بِالْمَعْرُوفِ وَ النَّهْيَ عَنِ الْمُنْكَرِ فَرِيضَةٌ عَظِيمَةٌ بِهَا تُقَامُ‌

الْفَرَائِضُ هُنَالِكَ يَتِمُّ غَضَبُ اللَّهِ عَزَّ وَ جَلَّ عَلَيْهِمْ فَيَعُمُّهُمْ بِعِقَابِهِ فَيُهْلَكُ الْأَبْرَارُ فِي دَارِ الْفُجَّارِ وَ الصِّغَارُ فِي دَارِ الْكِبَارِ إِنَّ الْأَمْرَ بِالْمَعْرُوفِ وَ النَّهْيَ عَنِ الْمُنْكَرِ سَبِيلُ الْأَنْبِيَاءِ وَ مِنْهَاجُ الصُّلَحَاءِ فَرِيضَةٌ عَظِيمَةٌ بِهَا تُقَامُ الْفَرَائِضُ وَ تَأْمَنُ الْمَذَاهِبُ وَ تَحِلُّ الْمَكَاسِبُ وَ تُرَدُّ الْمَظَالِمُ وَ تُعْمَرُ الْأَرْضُ وَ يُنْتَصَفُ مِنَ الْأَعْدَاءِ وَ يَسْتَقِيمُ الْأَمْرُ فَأَنْكِرُوا بِقُلُوبِكُمْ وَ الْفِظُوا بِأَلْسِنَتِكُمْ وَ صُكُّوا بِهَا جِبَاهَهُمْ وَ لَا تَخَافُوا فِي اللَّهِ لَوْمَةَ لَائِمٍ فَإِنِ اتَّعَظُوا وَ إِلَى الْحَقِّ رَجَعُوا فَلَا سَبِيلَ عَلَيْهِمْ- إِنَّمَا السَّبِيلُ عَلَى الَّذِينَ يَظْلِمُونَ النّٰاسَ وَ يَبْغُونَ فِي الْأَرْضِ بِغَيْرِ الْحَقِّ أُولٰئِكَ لَهُمْ عَذٰابٌ أَلِيمٌ هُنَالِكَ فَجَاهِدُوهُمْ بِأَبْدَانِكُمْ وَ أَبْغِضُوهُمْ بِقُلُوبِكُمْ غَيْرَ طَالِبِينَ سُلْطَاناً وَ لَا بَاغِينَ مَالًا وَ لَا مُرِيدِينَ بِظُلْمٍ ظَفَراً حَتَّى يَفِيئُوا إِلَى أَمْرِ اللَّهِ وَ يَمْضُوا عَلَى طَاعَتِهِ قَالَ وَ أَوْحَى اللَّهُ عَزَّ وَ جَلَّ إِلَى شُعَيْبٍ النَّبِيِّ ص أَنِّي مُعَذِّبٌ مِنْ قَوْمِكَ مِائَةَ أَلْفٍ أَرْبَعِينَ أَلْفاً مِنْ شِرَارِهِمْ وَ سِتِّينَ أَلْفاً مِنْ خِيَارِهِمْ فَقَالَ ع يَا رَبِّ هَؤُلَاءِ الْأَشْرَارُ فَمَا بَالُ الْأَخْيَارِ فَأَوْحَى اللَّهُ عَزَّ وَ جَلَّ إِلَيْهِ دَاهَنُوا أَهْلَ الْمَعَاصِي وَ لَمْ يَغْضَبُوا لِغَضَبِي.

در مورد عبارت و صکوا بها جباههم چند احتمال می رود
1. قبل از این جمله عبارت، قوم یتبع، آن قومی که یک ویژگیهایی حضرت برای آنها ذکر کرد، ضمیر «هم» به قوم برگردد. در این مورد برای اینکه مطلق موارد امربه معروف را بخواهیم از آن استفاده کنیم باید الغاء خصوصیت کنیم یا بواسطه قول به عدم فصل آن را اثبات کنیم. و بگوییم بین این قوم فاعل منکر و بقیه فاعلین منکر تفاوتی وجود ندارد.
2. ضمیر به کسانی که امام علیه السلام بعدا به مناسبت رسیدن کلام به این که اینها امر به معروف را رفض می کنند برگردد رفضوا اسمی الفرائض
3. احتمال سوم اینکه برگردد به هر دو طائفه، در این دو احتمال 2و3 نیازی به الغاءخصوصیت و قول به عدم فصل نداریم.
4. برگردد به اعداء ینتصف من الاعداء و یستقیم الامر فانکروا بقلوبکم و...
...
تقریب استدلال: آن است که استظهار بشود مرجع ضمیر یکی از سه تا باشد غیر از اعداء!
تحقیق: این استدلال مورد خدشه است و اشکالاتی به آن وارد است
اشکال اول: این روایت از نظر سند هم مرسله است و هم بعضی از روات آن محل اشکال هستند. احمد بن محمد بن خالد خودش آدم خوبی است ولی مشکل آن است که به مراسیل و افراد ضعیف نقل می کرده است و در این روایت هم ایشان عن بعض اصحابنا نقل کرده که حدیث مرسله است و نمی توان گفت که این بعض اصحابنا ثقه هستند به همین دلیلی که ذکر شد.
اشکال دوم: اینکه بشر بن عبد الله و قاضی مرو که توصیف نداشته مجهول هستند.
بررسی دلالی: محقق عراقی می فرمایند این روایت در خصوص باغین است نه عموم عاصین، و مرحوم صاحب جواهر هم می فرمایند این روایت مخصوص همین افراد مذکور در روایت است و عموم ندارد.
اگر ضمیر به .... برگردد در این مورد نمی توان الغاء خصوصیت کرد چون این گروه افراد خاصی هستند که ممکن است مولا بخواهد در مقابل آنها یک سرسختی خاصی داشته باشد او اگر واضح نشد که ضمیر به کدام برمی گردد چون در برخی احتمالات استدلال به روایت صحیح نیست لذا این مورد از حیز انتفاع برای استدلال خارج می شود.
صکو بها ، ضمیر بها به کجا برمی گردد در حالیکه اصلا کلمه ید در عبارت نداریم تنها چیزی که در عبارت داریم که ضمیر به آن برگردد کلمه فریضه عظیمه است که میتوان گفت با این فریضه به صورت آنها بزنید و انیکه مفروض گرفته شده این عبارت در مورد ضرب سیلی است محل اشکال است.
