طبق مبنای مشهور در حجیت تخییری، فقیه باید به یکی از دو متعارض که خودش اختیار کرده است، فتوا بدهد ولی طبق مبنای ما، فقیه باید حکم به تخییر کند.
و این معنا که ما از حجیت تخییری گفتیم، در کلام مرحوم شیخ به جماعتی- در مقام استفاده ی تخییر از نصوص تخییر- نسبت داده شده است و بعد احتمال داده است که تخییر اصولی درست باشد؛ زیرا مخاطب أخبار علاجیه، متحیّر است که مجتهد می باشد نه مقلّد. ولی در آخر، کلام جماعت را قوی تر می داند. (پس کلام شیخ در مورد مقام اثبات است و کلام شهید صدر در مورد مقام ثبوت است.)
