بیان دیگری برای مانع جریان استصحابین می توان فرض نمود: در جایی که مرددیم که یا این ظرف آب است یا خمر و با هر دو وضو بگیرد، می گویند که استصحاب بقاء حدث و استصحاب بقاء طهارت از خبث جاری می شود. پس باید دوباره وضو بگیرد. جعل این دو استصحاب که منتهی به جعل وجوب وضو بشود، لغو است؛ چون اثر مترتب بر اصل، باید محتمل الثبوت باشد و حال آن که در این جا قطعی العدم است.
همان طور که مرحوم خوئی فرموده است: لو كان هناك إناء و فيه مائع و شك في انه بول أو ماء فلا ريب في كونه محكوما بالطهارة ما لم يعلم بنجاسته و لكن لا يصح الوضوء منه بعد عدم إحراز كونه ماءا و لو توضأ فبالنسبة إلى الحدث يجرى استصحاب بقائه و بالنسبة إلى احتمال تنجس البدن يجرى استصحاب طهارته و لا تنافي بين جريان الأصلين بعد عدم لزوم المخالفة العملية من جريانهما كما هو ظاهر و لا مجال لتوهم شمول قاعدة الفراغ لمثل المقام الذي يكون احتمال انطباق المأتي به للمأمور به ناشئا من احتمال المصادفة الواقعية و لكن حيث يعلم بعدم الأمر بالوضوء الثاني(به خاطر لغویت جعلش) اما لصحة وضوء الأول أو لتنجس بدنه فلا بد(برای دفع لغویت) له اما من غسل مواضع الوضوء أو إحداث الناقض و التوضي بعد ذلك.
