ب. اگر قائل به وجوب ترجیح نشویم، ترجیح مرجوح بر راجح لازم می آید که قبیح بلکه ممتنع است.
مرحوم آخوند دو اشکال می کنند:
1- باید شارع مزیتی که در یک طرف است، را مقرّب به واقع بداند. ولی اگر این گونه نباشد، خودِ ترجیح دادن به چنین مزیتی، ترجیح بلا مرجّح است.
2- ترجیح بلا مرجح و ترجیح مرجوح، اگر داعی عقلائی نداشته باشد، قبیح است ولی امتناعی ندارد؛ زیرا تحقق ممکن بدون علت لازم نمی آید؛ زیرا خودِ اراده ی مختار، علت است.بلکه ترجّح بلا مرجّح(وجود ممکن بدون علت) امتناع دارد. ترجیح مرجوح هم از حکیم ممتنع الوقوع است.
بقیه ی وجوه را هم آخوند نمی آورند.
مرحوم شیخ وجه دیگری از سید مجاهد نقل می کند : اگر ترجیح واجب نباشد، اختلال نظام فقه و اجتهاد لازم می آید؛ زیرا لازمه اش قول تخییر است که باید بین هر ظاهر و نص متعارضی (مانند عام و خاص و مطلق و مقیّد) قائل به تخییر شد.
مرحوم شیخ به این وجه اشکال کرده است: این چنین تعارض هایی از محل بحث خارج است؛ زیرا محل نزاع در غیر موارد جمع عرفی است.
