بحث در این بود که روایت مقبوله دلالت بر مرجح بودن موافقت کتاب علی الاطلاق ندارد. موافق کتابی که مخالف عامه باشد و در طرف دیگر هیچکدام نباشد. اما اگ هر رایتی یکی از این دو مرجح را داشته باشند مقبوله نسبت به آن ساکت است.
لذا آقای خویی فرمود از رایت قطب می شود فهمید که با وجود موافقت کتاب نوبت به مرجح مخالفت عامه نمی رسد. همچنین مستفاد از روایت قطب این بود که در جایی که کتاب نسبت به مساله ای ساکت باشد هم ترجیح به مخالفت عامه مرجح است

مرحوم اخوند: مخالفت عامه برای تمییز حجت از لاحجت است نه ترجیح !
این مرجح در مقبوله و روای قطب آمده است که در روایت قطب روشن تر است.
روایات دیگری هم هست. اما مطلب جدیدی اضافه نمی کند الا دو نکته
آخوند: برای مخالفت عامه نیازی به روایت نداریم و علی القاعده است. زیرا اطلاق ادله حجیت نسبت به دو خبر متعارضی که یکی موافق عامه است و دیگری مخالف عامه، شامل خبر موافق نمی شود زیر اگر بخواهد شامل شود باید اصل عدم تقیه جاری شود ولی در چنین شرایطی این اصل جاری نمی شود. لذا تعبد به صدور آن نخواهیم داشت و تعبد به صدور خبر مخالف عامه بلامعارض خواهد بود.
دو طائفه دیگر در مخالفت عامه داریم
یک طائفه گفته عندالضروره می توان اخذ به مخالف عامه کنید اگر ناچار نیستید باید احتیاط کنید
طائفه دیگر مطلق مخالفت عامه را محک برای اخذ به روایت قرار داده و فرض تعارض نشده است.
