ترتیب بین مرجحات:
بین مرحوم شیخ و وحید بهبهانی و آخوند نزاعی وجود دارد.
مرحوم آخوند، منکر ترتیب هستند به این مبنا که ملاک در هر ترجیحی(چه صدوری و چه غیرش)، ترجیح صدوری است؛ زیرا بعدا از این که اصل اولی تساقط بود، شارع می فرماید تعبداً یک خبر را حجت بدان که معنایش تعبد به صدور است.
مرحوم شیخ: مرجح صدوری بر غیرش مقدم است.
مرحوم وحید و رشتی: مرجح جهتی بر صدوری مقدم است.
مرحوم آخوند ابتدا کلام شیخ را می آورد و در مقام رد کردن می فرماید:
اگر قائل به تعدی از مرجحات منصوصه شویم، دیگر رعایت ترتیب جا ندارد؛ زیرا وجه تعدی، این بود که مرجح باید موجب اقربیت شود.
اگر قائل به تعدی نشدیم، قول به ترتیب جا دارد ولی باز قائل به آن نمی شویم؛ زیرا مهم ترین دلیل بر رعایت ترتیب، مقبوله است که در مقام بیان ترتیب نمی باشد؛ زیرا لازمه ی بیان ترتیب، تقیید اطلاقات کثیری است که تنها یک مرجح جهتی آورده اند.
مرحوم شیخ در ضمن کلامش اشاره به اشکالی کرده است: همان گونه که در تعارض بین ظاهر و اظهر، مرجح صدوری را مقدم نمی کنید، در غیر آن هم نباید مرجح صدوری را مقدم کنید و باید بین صدور هر دو جمع کرد.
مرحوم شیخ جواب می دهد: متعبد کردن نسبت به صدور آن چه که تقیه ای بیان شده، لغو است.
مرحوم آخوند به مرحوم شیخ اشکال می کند: همین جواب شما، معنایش این است که همه ی مرجحات به مرجح صدوری بازگشت دارند.
حق با مرحوم شیخ است؛ زیرا به خاطر تعبد، قائل به ترجیح شدیم، پس در ترتیب آنها باید ترتیب مذکور در اخبار، رعایت شود. تقیید یک روایت نسبت به اطلاقات متعدد، هیچ بُعدی ندارد.
