2- دلالی: أ. عدم فرق بین طوایف مختلف در حدود و تعزیرات از مسلّمات است. پس به طریق اولی در امر به معروف غیر لیّن هم فرقی نباید باشد. (جواب: از آن طرف در بعض احکام -مانند زکات و صدقه- بین سادات و غیرشان تفصیل داده شده است.) ب. بنابر مبنای این که اگر ظن بر خلاف داشته باشیم، اماره حجت نمی باشد، پس این روایت به خاطر بعید بودن این تفصیل و ظن بر خلافش حجت نمی باشد.(جواب: ما این مبنا را قبول نداریم.) ج. این تفصیل مخالف اجماع یا شهرت است. (جواب: این اجماع محتمل المدرکی است. مخالفت کردن با شهرتی که از روی اجتهاد باشد، اشکالی ندارد. در این جا هم احتمال دارد که فتوای مشهور از روی اجتهادات باشد.)
