جواب: این احتمال که احتمال دوم مرحوم کاشف الغطاء عبارت است از این که شما خود قبول دارید ظهور بدوی این فقره از روایت ثالثه در استصحاب و بناء بر اقلّ است لیکن به خاطر ضرورت مذهب و ظهور فقره اولی دست از این ظهور بدوی داشتید و مفادّ آن را قاعده احتیاط دانستید اگرچه خلاف ظاهر بود حال ما می گوییم تنها احتمال خلاف ظاهر قاعده احتیاط نیست که بخواهید آن را اخذ کنید بلکه احتمال خلاف ظاهر دیگری هم دارد که عبارت است از این که معنای جامعی را بگیریم که هم قاعده احتیاط را بگیرید هم قاعده استصحاب را و آن عبارت باشد صرف بقاء بر یقین اعم از این که بناء بر یقین سابق باشد یا بناء بر تحصیل یقین. در این صورت در نماز معنای قاعده احتیاط به ضمیمه قرائن دیگر مراد است و در جاهای دیگر قاعده استصحاب.
نقد مصنف به این احتمال این است که جامعی بین دو قاعده قابل تصور نیست فضلا از این که روایت در آن ظهور داشته باشد و فضلا از این که برویم سراغ این مطلب که ممکن است لازمه جامع معنوی گرفتن این باشد که روایت اجمال پیدا کند. اگر سراغ این اشکالات بعدی هم نرویم می گوییم اصلا جامع انتزاعی بین دو قاعده قابل تصور نیست. زیرا مناطشان و رکن هایی که در صورت وجود آن رکن ها قاعده پیاده می شود با هم مانعه الجمع است. زیرا یکی می گوید لحاظ حالت سابقه ملاک است اگرچه احتمال عقاب ندهید. دیگری می گوید احتمال عقاب ملاک است اگرچه حالت سابقه ملحوظه نداشته باشید یا حالت سابقه ملحوظه احتمال عقاب نداشته باشد.
