شواهدی در روایات است که مجرد نهی پیامبر موضوع حرمت نبوده و نهی های حضرت اعم نهی تحریمی و اعافه ای بوده است یا ممکن است در برخی موارد نهی از جایگاه حاکم بوده. از این روایات بر می آید که نهی های تحریمی مشخصه ای داشته است.
مقتضای قسمت پایانی روایت تساقط است و ترجیح و... را نفی می کند.
بنابرین این روایت هم تخییر را اثبات نمی کند.

روایت ششم:
روایت موثقه سماعه بن مهران
این روایت سندا قابل اعتماد است هر چند سماعه از نظر مذهب واقفی است
7- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عُثْمَانَ بْنِ عِيسَى وَ الْحَسَنِ بْنِ مَحْبُوبٍ جَمِيعاً عَنْ سَمَاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ اخْتَلَفَ عَلَيْهِ رَجُلَانِ مِنْ أَهْلِ دِينِهِ فِي أَمْرٍ كِلَاهُمَا يَرْوِيهِ أَحَدُهُمَا يَأْمُرُ بِأَخْذِهِ وَ الْآخَرُ يَنْهَاهُ عَنْهُ كَيْفَ يَصْنَعُ فَقَالَ يُرْجِئُهُ‏ «2» حَتَّى يَلْقَى مَنْ يُخْبِرُهُ فَهُوَ فِي سَعَةٍ حَتَّى يَلْقَاهُ وَ فِي رِوَايَةٍ أُخْرَى بِأَيِّهِمَا أَخَذْتَ مِنْ بَابِ التَّسْلِيمِ وَسِعَكَ‏ «3». ;کافی
