اشکالات مرحوم صدر به مرحوم خوئی وارد نمی باشد؛ زیرا همان طور که دلیل بر چیزی، کاشف از ملزوم عقلی است (فلذا گفته می شود که لوازم امارت حجت است.)، کاشف از لوازم شرعی هم هست و فرقی بین مدلول التزامی تکوینی و اثر شرعی نمی باشد. و اشکال مرحوم خوئی به مرحوم نائینی همین است که شما در ملازمات عقلی قائل به کاشفیت هستید، پس باید در ملازمات شرعی هم همین را قائل باشید.
اشکال حلی مرحوم آقای خویی این بود که اخبار از ملاقات لباس با خون، ملازم با مطلق نجاست لباس نیست بلکه ملازم با حصه خاصی از نجاست است که در اثر ملاقات لباس با آن خون خاص حاصل می‌شود، پس وقتی مدلول مطابقی حجت نبود اصلا مدلول التزامی شکل نمی‌گیرد. و در نفی ثالث هم همین طور است یعنی هر دلیل چون مدلول مطابقی خودش را اثبات می‌کند غیر آن را نفی می‌کند و اگر مدلول مطابقی‌اش حجت نباشد، بر نفی غیر آن هم دلالت نمی‌کند.
اشکال مرحوم صدر به جوابِ حلی مرحوم خوئی:
این کلام در لوازم شرعی درست است اما در لوازم عقلی درست نیست. یعنی اخبار از ملاقات لباس با خون، ملازم با مطلق نجاست نیست بلکه ملازم با حصه خاصی از نجاست است و این چون نجاست حصص مختلفی دارد که فقط یک حصه آن با ملاقات با این خون خاص ملازم است اما لوازم عقلی این طور نیستند. لازمه خبر دال بر وجوب نماز جمعه، عدم اباحه آن است نه اینکه لازم آن حصه خاصی از عدم اباحه باشد که مقارن با وجوب آن است. عدم اباحه به طور مطلق از لوازم وجوب شیء‌ است نه اینکه وجوب مستلزم عدم اباحه خاصی است (یعنی مستلزم عدم اباحه مقارن با وجوب نیست) چون این مقارنت با وجوب در حیث استلزام و تاثیر ملزوم در لازم، تاثیری ندارد. درست است که مورد تاثیر وجوب در عدم اباحه مقارن با وجوب است اما این مقارنت در آن تاثیر و استلزام نقشی ندارد و این طور نیست که وجوب فقط مقتضی عدم اباحه مقارن با وجوب باشد بلکه مقتضی مطلق عدم اباحه است هر چند لامحاله در اینجا در عدم اباحه مقارن با وجوب تاثیر کرده است.
