خارج فقه استاد شب زنده دار

اشکال این شد که مرحوم ابن طاووس فرموده بین نقل کلینی,و دیگران تفاوتروجود دارد و ما حجت اجمالی پیدا میکنیم که برخی فقرات حجت نمیشوند یا به جهت تعارض انها باهم یاوبه جهت دوران بین نقصان و زیاده لذا تمسک محل اشکال است
الاعتبار نویسنده معروف به الشجری در این کتاب نسخه های دیگر امده و در ان نسخه این فقره امده است
بنابرین این اشکال دوم بعد از این فحص ممکن است کسی ان را وارد نداند مگر اینکه بگوییم صاحب این کتاب که زیدی هم هست استناد این روایات به نحو ارسال است مگر اینکه به نحو شخصی اطمینان به تطابق پیدا کند.
اشکال سوم
واو به معنای جمع بین این دو مرتبه باشد( باید معا اتیان شوند) این بیان معرض عنه اصحاب است

گاهی واو به معنای او میاید
واو در مواردی ظهور در جمع دارد که با یکی از انها ممکن است مصلحت مورد نظر استیفا نشود ولی در جاییک ه یکی از متعاطفین مصلحت حاصل میشود مثل اینکه بگویند از یکی از دو در خارج شوید منظور خروج از از هرکزام که باشد,تفاوتی نمیکنید
اینکه هرکدام از متعاطفین اثر را مترتب میکند قرینه میشود که مولا در تمام موارد امربهمعروف جمع بین موارد را نمیخواهد البته در مواردی که غرض با یکی از انها حاصل نمیشود جمع لازم است

نتیجه این میشود که یا این فقره مختص فرد خاص است یا به اجمال می انجامد و در این جا فتوا سخت است یا باید علی نحو الاشکال یا با ارجاع به دیگران احتیاط کرد
