خارج اصول استاد قائنی 1397/7/22 باب تعادل وتراجیح-مبحث ورود علیرضا عسکری

بعد از روشن شدن حقیقت ورود: انتقاء یا تحقق موضوع دلیل دیگری حقیقتا بواسطه تعبد

آثار و تبعات: ورود متقوم به لفظ نیست برخلاف حکومت. در مثل ورود حتی دلیل وارد میتواند لفظی نباشد.بله ورود نیاز به تعبد ولو تعبد بوسیله اجماع دارد.مثلا اجماع بر حجیت شهریت(دلیل لبی) اگر فرض شد ،آن را وارد بر قاعده قبح عقاب (دلیل دلبی است)میکند. خود اجماع آنجایی که حجت باشد وارد است.بله معقد اجماع لفظ است اما اجماع دلیل لبی است. یا وروددلیل لبی اجماع بر دلیل لفظی : ما کنا معذبین حتی نبعث رسولا(وارد غیر افظی و مورود لفظی)
حکم عقل به اعتبار ظن انسدادی بناءا علی الکشف وارد است(حکم عقل کاشف از تعبد و جعل شارع است)اما بناءا علی الحکومت خروجش از قبح، خروج تخصصی است.عقل معنا ندارد دو حکم متضاد داشته باشد.یک قبح بلا بیان که شامل ظن انسدادی هم شود و یک حکم به ظن انسدادی.لذا خروج آن تخصصی و بوسیله حکم عقل است

نتیجه :پس ملاک این بود که موضوع حقیقتا محقق یا متفی شود چه با دلیل لفظی چه با لبی مانند اجماع و به یک دلیل هر دو وارد هستند

امر ششم
هر جا شک در ورود شد، شبهه مصداقیه دلیل مورود است و تمسک به مورود در موراد شک در ورود مساوق با تمسک به عام در شک در مصداقیه دلیل است
(شک در ورد همان و شک در تحقق موضوع مورود همان .زیرا شک در ورود شک در انتفاء موضوع موروداست حقیقتا )
هر جا احتمال ورود شد مساوق با شک در صدق مورود است.زیرا احتمال ورود یعنی احتمال عدم صدق موضوع مورود.
نتیجتا شک در ورود همان و عدم تمسک به اطلاق مورود همان
با شک در وجوب حج معنا ندارد به اطلاق وجوب وفای به نذر تمسک کرد
وجوب وفا به نذر لولائی است.و اگر حج واجب شد، دیگر وجوب وفا آنجا را شامل نمیشود
درضمن اصل برائت نمیتواند موضوع وفای به نذر را درست کند زیرا برائت باید متضمن رفع باشد نه ایجاد کلفت و این برائت مستلزم وضع(وجوب وفا) می باشد.
علاوه بر اینکه اصل برائت نفی وجوب نمیکند(وجوب حج) و میگوید بر ترک حج عقوبت نیست و معذری و اگر موضوع وجوب وفای به نذر ،عدم تنجز حج میبود برائت از این جهت مشکلی نداشت اما باز اشکال اول(برای امتنان است و مخالف وضع تکلیف) باقیست
هذا ؛ اونجایی که ورود با وجوب واقعی محقق شود
اما اگر ورود با وصول محقق شود ، شک در حجیت همان و قطع به عدم حجیت و ورود همان.شک در حجیت مساوق با قطع به عدم حجیت است. یعنی شک در بیانیت نداری بلکه قطع به عدم بیانیت است.حجیت بوصلها بیانیت است.بخلاف موارد ورود به وجوبها الواقعی که شک در وجوب واقعی مساوق با شک در ورود و آن شک در شبهه مصداقیه دلیل مورود است.

بقی الکلام : جمع بندی حکومت

همین مراحل(حقیقت حکومت / ملاک تقدم حاکم / آثار و تبعات حکومت)
حقیقت حکومت
نظارت دلیل حاکم بلفظه نسبت به دلیل محکومی که آن هم لفظ است. و معنای حکومت ، متقوم نظارت است و دلیل حاکم مفسر دلیل محکوم است؛ نه به ملاک عرف . وقضاء العرف بالجمع نیست بلکه قضاء المتکلم بالجمع است.لذا در حکومت خود حاکم و متکلم به دلالت لفظی و به تعبیری به قرینیت شخصیه (در مقابل جمع عرفی و قرینیت عرفیه) ولو به مثل اعنی و ما فی حکمها منظورش را مشخص میکند.
حال مفسر مدلول استعمالی باشد یا حکم لوحی باشد اما متضمن دال لفظی هست.
شرح و تفسیر بالدلاله لفظیه است نه از باب استلزام عقلی. بله اگر دلالت لفظی از باب استلزام عقلی بود اشکال ندارد
نتیجتا حکومت منحصر در یک قسم است و متقوم وجود محکوم است ولو محکوم از خوددلیل حاکم فهمیده شود.

نکته ی حکومت ، امری است در تقدیم دلیل حاکم که با تخصیص فرق دارد. واستدلال (دلیل حاکم متعرض امریست -نفی و اثبات موضوع محکوم-که محکوم از این جهت سکوت دارد. لذا مثلا جعل علمیت برای خبر ،با دلیل ما کنا معذبین منافات ندارد)باطل است.وخلط بین نکته ورود با حکومت است. در ورود است که دلیل مورود نسبت به موضوع خودش نفیا و اثباتا نظارتی ندارد ولی در حکومت با تعبد شارع که علم درست نمیشود و موضوع حقیقتا از بین نمیرود. پس موضوع دلیل محکوم هنوز باقیست و از طرفی موضوع دلیل حاکم نیزوجود دارد و تنافی می باشد . لذا ملاک تقدم حاکم بر محکوم همان شرح و نظارت لفظی است.
اگر هرچه را که مقدم شد اسمش را میخواهید بگذارید حکومت اشکالی ندارد و لامشاحه فی الاصطلاح اما نکته تقدم در تخصیص با حکومت فرق دارد.

نکته تقدم حاکم
شرح و تفسیر است که از دید عرف و در بناء عقلا حق دارد شخص مقصود و مراد جدیش را تعیین کند با قرینه منفصله کما اینکه با متصله حق داشت .
موارد مجاز حکومت
نسبت به متصله : مادامی که فراقت از کلام پید نکرده حق دارد قرائنش را بیاورد و ظهور براساس مجموع قرینه و ذی القرینه شکل میگیرد.
اما در منفصله : در تقیینات این حق وجود دارد و عرف میپذیرد اما در اقاریر این حق وجود ندارد.
