جابریت اجماع منقول از خبر ضعیف از منظر شیخ اعظم قدس سره

چکیده

اجماع منقول از تراث مهم فقهی است که در دایره¬ی نگاه صفر و صدیِ حجیت و عدم حجیت بخاطر عدم ادله¬ی کافی محکوم به عدم حجیت است. اما در نگاه دقیق مرحوم شیخ اعظم قدس سره جایگاه ویژه¬ای برای آن دیده می¬شود. ایشان هم در مباحث اصولی این جایگاه را به خوبی نشان می¬دهند هم در جای جای فقه، در استنباطات خود مرهون این تراث مهم هستند. یکی از کارآیی¬های اجماع منقول که از بدیعیات مرحوم شیخ اعظم قدس سره است، جابریت آن از خبر ضعیف است. مرحوم شیخ قدس سره جنبه¬های اصولی این مهم را در کتاب فرائد الاصول در ذیل مباحث حجیت اجماع منقول و کاربردهای آن را در لابه¬لای فروع فقهی بررسی کرده¬اند اما آن را بصورت یک ضابطه و کارایی مستقل از اجماع منقول معرفی نکرده¬اند. در این نوشتار سعی شده است با بررسی مباحث اصولی مرحوم شیخ انصاری ره در باب اجماع منقول مبانی نظری و تئوریک این کارآیی و با بررسی مباحث فقهی ایشان در ابواب مختلف کاربست¬های این فقیه از این کارآیی به ضابطه¬ای در این بحث نزدیک شود. در بخش اول این مقاله به بیان مبانی اصولی جابریت اجماع منقول و دفع اشکالات مطرح شده پرداخته شده است و در بخش دوم دو نحوه جابریت دلالی و سندی در مباحث فقهی شیخ اعظم بررسی شده است.
