تقریر اصول 28 فروردین

مرحوم صدر به دلالت این روایت بر تخییر، اشکال دیگری فرموده است : احتمال دارد که مورد روایت، تعارض روایات در اصول دین باشد، به سه قرینه:
1- "یأمر بأخذه"، که اخذ با اعتقاد می سازد.(فیه: اخذ با عمل کردن هم می سازد، همان طور که در روایات حجیت خبر ثقه آمده: وَ عَنْهُ عَنْ مُحَمَّدِ بْنِ نُصَيْرٍ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ عَبْدِ الْعَزِيزِ بْنِ الْمُهْتَدِي وَ الْحَسَنِ بْنِ عَلِيِّ بْنِ يَقْطِينٍ جَمِيعاً عَنِ الرِّضَا ع قَالَ: ...أَ فَيُونُسُ‏ بْنُ عَبْدِ الرَّحْمَنِ ثِقَةٌ آخُذُ عَنْهُ مَا أَحْتَاجُ إِلَيْهِ مِنْ مَعَالِمِ دِينِي... )
2-"یرجئه..." با اعتقادیات(که در آن طلب معرفت می شود) می سازد ولی در فروع، اقتضاء امتثال وجود دارد و ارجاء موجب تفویت می شود.
3- تعارض بین وجوب و حرمت در روایات، امر نادری است.(فیه: نادر بودن مورد، موجب لغویت است ولی سؤال کردن از فرد نادر-کما نحن فیه- اشکالی ندارد.)
اشکالات بیان ایشان واضح است.
دو روایت بعدی که مرحوم اصفهانی می آورند، مرسله ی کلینی است که یکی را دنباله ی روایت سماعه آورده است: بِأَيِّهِمَا أَخَذْتَ مِنْ بَابِ التَّسْلِيمِ وَسِعَكَ. و دیگری را در دیباجه ی کافی آورده است: بأيهما أخذتم من باب التسليم وسعكم.
سند هر دو روایت غیر معتبر است.
مرحوم اصفهانی به دلالت هر دو روایت اشکال فرموده است : این دو روایت، قطعاً نقل به معنا شده اند و روایات مستقل از روایات دیگر نیستند. علاوه بر این که روایت اول صدری داشته است که کلینی نیاورده است. پس به اطلاق آن نمی توان تمسک کرد.
اشکال دوم ایشان درست نیست؛ زیرا وقتی کلینی بعد از روایت سماعه، این روایت را می آورد، معنایش این که در همان موضوع، روایت دیگری را نقل به معنا می کند. پس صدر روایت برای ما معلوم است.
