راه حل سوم مرحوم شهید صدر برای تقدیم مخصص منفصل بر عام
بگوییم از متکلم عام‌های متعدد و خاص‌های معارضی به ما رسیده؛ بدانیم ظاهر بعضی از عمومات اراده نشده و در عین حال ندانیم آیا همه خاص‌ها مقصود بوده اند یا خیر؟
ب این اوصاف تقدیم خاص ها بر عمومات رجحان دارد و تقدیم عمومات ترجیح بدون مرجح خواهد بود؛ زیرا با توجه به اینکه می‌دانیم قطعا برخی از عام‌ها مراد متکلم نبوده، خلاف علم تفصیلی (عدم اراده جمیع عمومات) عمل کرده‌ایم و اگر فقط برخی از عمومات را تقدیم کنیم به علم اجمالی بی اعتنایی کرده‌ایم.:122fs329172 (2):

اولا: علم داریم به اینکه این متکلم عمومات زیادی دارد که مخصصاتی هم بر خلاف آن دارد
ثانیا: علم اجمالی داریم که بعض از این مخصصات مطابق حکم واقعی و مراد جدی است یعنی اینگونه نیست که همه این مخصصات مراد نباشد
ثالثا: علم اجمالی به مراد جدی بودن بعض عمومات نداریم و بّعدی ندارد که همه عمومات اراده نشده باشد
در نتیجه تقدیم همه عمومات صحیح نیست چرا مخالف علم اجمالی ماست و از طرفی تقدیم بعض عمومات ترجیح بلا مرجح است و تنها راهی که محذوری ندارد تقدیم همه مخصصات است و ترجیح بلا مرجح هم پیش نمی آید.

از شارع عمومات زیادی صادر شده است و در عین حال مخصصات هم ذکر شده است که با این عمومات تعارض دارد، و ما علم اجمالی داریم که برخی از این مخصصات صادق هستند و بعضی از عمومات ظاهرش قصد نشده است. در همین فرض ما علم اجمالی نداریم که برخی از مخصصات هم ظاهرشان قصد نشده باشد. در چنین حالتی تقدیم مخصصات بر عمومات رجحان دارد، چون که موافق علم اجمالی ما خواهد بود. اما اگر بخواهیم عمومات را مقدم بر مخصصات کنیم اگر همه عام ها را مقدم کنیم که مخالفتت با علم اجمالی است زیرا می دانیم که برخی از عمومات کاذب هستند، و تقدیم برخی از عمومات هم ترجیح بلا مرجح است.
