جلسه پانزدهم
جلسه پانزدهم شما رؤیت شد و نکاتی که لازم بود در کامنت ها ثبت گردید
بحث در مساله‌ای بود که مرتد کافری را بکشد آیا قصاص ثابت است؟ و بر فرض قصاص ثابت نباشد دیه ثابت است؟
در این مسأله است که اگر مرتدی کافری را کشت قصاص ثابت است یا خیر؟ و در صورت ثابت نبودن قصاص، آیا دیه ثابت می شود؟
صاحب جواهر در مقابل آنچه به عنوان شواهد حرمت مرتد ذکر شده است مواردی را برشمرده‌اند که مرتد از کافر اصلی بدتر و بی‌حرمت‌تر است. مثلا جزیه از کافر اصلی قبول است و از مرتد جزیه قبول نیست. و مرتد واجب القتل است به خلاف کافر اصلی که قتلش واجب نیست. ذبیحه مرتد اجماعا حلال نیست اما در ذبیحه کتابی اختلاف نظر وجود دارد.

المسألة الرابعة:
إذا قتل مرتد ذميا ففي قتله تردد كما في القواعد منشأه تحرم المرتد بالإسلام المانع من نكاحه الذمية، و من إرث الذمي له، و من استرقاقه، و المقتضى لوجوب قضاء الصلاة عليه لو أسلم و لكن مع ذلك يقوى أنه يقتل وفاقا للفاضل و غيره ممن تأخر عنه، بل و للمحكي عن المبسوط و الخلاف للتساوي في الكفر، كما يقتل النصراني باليهودي، لأن الكفر كالملة الواحدة و لإطلاق أدلة القصاص المقتصر في الخروج عنها على عدم قتل المسلم بالكافر، إذ لا دليل على اعتبار التساوي على وجه يقتضي خروج المفروض، بل لعل المراد من اشتراط‌ التساوي في عبارة الأصحاب و لو بقرينة التفريع هو عدم قتل المسلم بالكافر.
و من ذلك يعلم عدم أثر لما سمعته من أحكام المرتد في سقوط القود عنه الذي يمكن مقابلته بما يقتضي كونه أسوأ حالا من الذمي، كوجوب قتله مع عدم التوبة دونه، و عدم حل ذبيحته إجماعا بخلاف الذمي الذي اختلف فيه، و عدم إقراره بالجزية و غير ذلك. نعم هذا كله مع بقائه على الارتداد.
آن قسمتی از متن که خصوصیت دارد در متن بیاید. لذا در اینجا بهتر است مطلب مربوط به متن، در پاورقی بیاید
ولی عمده برای ثبوت یا نفی قصاص نه ان وجوهی است که دیروز ذکر شد و نه این وجوه، بلکه ملاک اطلاقات ادله قصاص است و
به جای «و» باید «که» گذاشته شود در مورد مرتد مخصصی وجود ندارد.
در ادامه همین مساله مرحوم خویی می فرماید
فرموده است که اگر شخص قاتل بعد از جنایت توبه کرد، چه مرتد فطری و چه مرتد ملی، قصاص ساقط می شود، اما مرتد ملی سقوط قصاص واضح است
آما در مرتد ملی ساقط می شود؛ زیرا،چرا که توبه او پذیرفته شده است و حتی مسقط حد ارتداد هم هست
عبارت «حتی مسقط حد ارتداد هم هست و قصاص هم ساقط است» زائد است و قصاص هم ساقط است چون ملاک حال قصاص است و در این حال اگر بخواهد قصاص شود دلیل لایقاد المسلم بذمی، آن را شامل می شود.

اما درحق مرتد فطری ساقط است؛ زیرا هرچند توبه او....موثر نیست، ولی ما بینه و بین الله ...اما مرتد فطری، توبه او نسبت به اسلام و احکام ثلاثه(زوجیت، اموال، حد) موثر نیست، اما اگر قائل شدیم که توبه او فی ما بینه و بین الله مقبول است به این معنا که احکام دنیوی او هم مقبول است یعنی مثلا بدن او نجس نیست، و اینکه چون محکوم به قتل است دلیل بر عدم اسلام او نیست، چرا که موارد زیادی داریم که شخصی محکوم به قتل است ولی مسلمان است مانند شخص زانی، و یا اینکه می تواند بر زوجه قبلی خود هم عقد ببندد حتی در زمان عده، چرا که عده برای غیر زوج قبلی است.

در این قسمت عنوان زده شود و دلیل مختار استاد را بیاور که چرا مرتد فطری بعد از توبه مشمول احکام مسلمین است مگر...در حالیکه ما دلیلی نداریم که المرتد کافر حتی لو تاب، بلکه اطلاق ادله توبه اقتضا می کند که توبه او هم قبول می شود، البته به غیر از احکام ثلاثه.
در نتیجه در این صورت تمام احکام مسلمین جاری می شود و از جمله احکام عدم قصاص است، هر چند به خاطر ارتدادش او کشته می شود، در نتیجه محکوم به دو اعدام است یکی به خاطر ارتدادش و دیگری به خاطر قتلش، و ثمره‌اش در برخی موارد روشن می‌شود مثل اینکه حاکم بنابر مصالحی نتواند حکم ارتداد را جاری کند یا اینکه حاکم به او دسترسی نداشته باشد یا اینکه ولی دم از قصاص گذشت کند یا اگر ولی دم را مخیر بین قصاص و اخذ دیه بدانیم می‌تواند از او دیه مطالبه کند.

اما در مورد دیه، چی؟ آیا ضامن دیه هم هست؟
مطلب فراتر از گفتاری است، به نوشتاری تبدیل شود
مرحوم محقق فرموده که بله
کلمه «بله» زائد است ضامن است، چرا که مقتول کافر ذمی است و محقون است،
گویا ایشانو گویا به اطلاق ادله دیه ذمی تمسک کرده است.
مرحوم صاحب جواهر می فرماید که امکان دارد که قائل شویم دیه ثابت نیست، چرا که قتل عمدی بوده است و قتل عمدی موجب قصاص است و قصاص هم ساقط شد، و از طرفی هم موجبی برای ثبوت دیه نیست.
و لكن عليه دية الذمي كما في القواعد و غيرها مع إمكان القول بعدمها أيضا إن لم يكن إجماعا، باعتبار كون الواجب عليه القصاص، و الفرض سقوطه عنه بالإسلام، اللهم إلا أن يستفاد من الأدلة قيامها مقامه في كل مقام تعذر استيفاؤه على وجه يشمل الفرض، و ربما يأتي لذلك تتمة إن شاء الله.
